White House Ends Section 232 Duties Exceptions for EU, Canada & Mexico on June 01
Today the White House posted two Presidential proclamations removing the exemptions from additional Section 232 duties on steel and aluminum products for EU, Canada and Mexico effective June 1 at 12:01 a.m. Therefore steel from all countries except Australia, Argentina and Brazil will be subject to an additional 25% tariff. Aluminum from all countries except Australia and Argentina will be subject to an additional 10% tariff.
In addition, effective June 1, Argentina and Brazil will join South Korea for absolute quota on steel products. Aluminum products from Argentina will also be subject to absolute quota effective June 1. The quota quantitative limitations for calendar year 2018 shall take into account all articles imported since January 1, 2018.
For shipments from the EU, Canada or Mexico arriving to the first U.S. port of unlading on or before May 31, it is recommended that an Elected Entry Date be requested to Customs based on the date of vessel arrival for pre-filed entries, or the date of filing for vessels that have already arrived, in order to secure the duty exception. The request must be filed with Customs through their Document Imaging System (DIS) for those entries.
Any admissions into a Foreign Trade Zone must be made under “privileged foreign status” and are subject upon entry for consumption to any ad valorem rates of duty imposed by the Proclamations.
No drawback shall be available with respect to the Section 232 duties imposed upon any aluminum or steel article.
