UPDATE: GSP Reinstatement Date Set as 30 Days from Date of Enactment of Omnibus Bill
President Donald Trump has signed the Omnibus Spending bill on March 23, 2018, which included renewal of the Generalized System of Preferences (GSP) bill that was renewed through December 31, 2020.
According to the text of H.R. 1625, otherwise known as the “Consolidated Appropriations Act, 2018“, the GSP program is scheduled to be reinstated 30 days after enactment of the bill. Since the bill was enacted on March 23, 2018, the 30th day will fall on or about April 22, 2018.
Therefore, duties must continue to be deposited for Customs entries of GSP-eligible merchandise entered until about April 22, 2018.
Duties will be automatically refunded for all GSP eligible Customs entries filed January 1 to April 22, 2018 that were flagged with the appropriate GSP Special Program Indicator. GSP-flagged entries will be liquidated or re-liquidated with refunds that will be issued within 90 days from the dates of liquidation of the entries.
In the event that any GSP eligible entries were not flagged at the time of entry, written requests must be submitted within 180 days from the date of enactment (by on or around September 19, 2018) including all supporting documentation to justify a refund. If you believe any of your GSP-eligible entries were not flagged for GSP and would like to submit a written request for a refund, please contact your nearest James J Boyle & Co representative for assistance.
A Customs Cargo Systems Messaging Service (CSMS) message with instructions confirming the above is expected to follow soon.
